Terms of Service

    1. Acceptance of Terms

    By accessing or using InterviewCandy's AI-powered interview platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including employers, enterprise clients, invited candidates, and team members.

    2. Description of Service

    InterviewCandy provides an AI-powered conversational interview platform that enables:

    • For Employers & Enterprise: AI-conducted candidate screening interviews based on job descriptions, with assessment reports, interview recordings for review, custom evaluation rubrics, candidate comparison tools, team member access with role-based permissions, and analytics.
    • For Invited Candidates: No-login interview access through organization-provided links, with AI-led interviews, transcripts, recordings where enabled, and scorecards made available to the inviting organization.

    Features and availability may vary by plan. Not all features described may be available at all times; we continuously develop and expand the Service.

    Team Access & Roles

    Enterprise account owners may invite team members to their organization with assigned roles (admin, recruiter, or viewer). The account owner is responsible for managing team member access and ensuring that invited members comply with these Terms. Each role determines the level of access to candidate data, job management, and organizational settings. The account owner retains full responsibility for all actions taken by team members within the organization.

    Candidate Invitations

    Enterprise users may invite candidates to interview by providing their name and email address, either individually or via CSV upload. By using these features, you authorize InterviewCandy to send invitation emails to candidates on your behalf. You represent that you have the right to provide candidate contact information and that candidates have a reasonable expectation of receiving interview-related communications from your organization.

    3. Account Registration

    You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

    4. AI-Powered Interviews

    Nature of AI Assessments

    AI-generated interview scorecards, scores, and feedback are provided as decision-support and self-improvement tools only. They do not constitute employment advice or career counseling. Employers who use AI-generated assessments retain full responsibility for hiring decisions and must ensure compliance with applicable employment and anti-discrimination laws.

    Recording & Consent

    By starting an interview through the Service, you consent to the recording and processing of your audio and video by our AI models for the purpose of conducting the interview. Interview sessions may be recorded (video and audio) where supported by your browser and stored securely on Google Cloud Platform. Recordings are used to enable interview playback and review by you and, for enterprise accounts, by authorized members of the organization that invited you. A visible "Session recorded for scoring" indicator is displayed during recording. Interview recordings, text transcripts, and AI-generated scorecards are stored securely in accordance with our Privacy Policy.

    Where enabled by the inviting organization, interview audio, video, transcripts, and related session data may also be processed by AI systems to help identify interview integrity signals, such as another person appearing on camera, camera obstruction, or visible use of external materials. Such signals are provided for review and are not automatic proof of misconduct. InterviewCandy does not automatically fail candidates or make hiring decisions based on interview integrity signals.

    Enterprise Data Ownership

    For enterprise accounts, interview recordings and scorecards for candidates invited by the organization are accessible to authorized organization administrators. The organization retains the right to review, download, and manage recordings for candidates they have invited. Candidates retain the right to access their own interview data and request its deletion.

    Fairness & Bias

    We are committed to developing and maintaining fair AI systems. We regularly review our prompts and models to identify and mitigate potential biases. If you believe an assessment was unfair, you may contact us for review.

    5. Acceptable Use

    You agree not to:

    • Use the Service for any unlawful or discriminatory purpose
    • Attempt to reverse-engineer, manipulate, or game the AI system
    • Impersonate another person during an interview
    • Use the Service to collect personal data without proper consent
    • Upload malicious content, viruses, or harmful code
    • Exceed your plan's usage limits through automated or abusive means
    • Share interview reports or assessments without authorization from the relevant parties
    • Violate any applicable local, state, national, or international law

    6. Intellectual Property

    All platform content, AI configurations, software, branding, and documentation are the intellectual property of InterviewCandy. Users retain ownership of the job descriptions they submit and their interview responses. Employers retain ownership of their proprietary hiring criteria. We are granted a limited license to process this content solely for the purpose of providing the Service.

    7. Payment & Subscriptions

    Certain features require a paid subscription. Fees are billed in advance on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.

    8. Limitation of Liability

    To the fullest extent permitted by law, InterviewCandy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

    9. Disclaimer of Warranties

    The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that AI-generated assessments or feedback will be error-free, unbiased, or suitable for any specific hiring decision. We disclaim all liability for decisions made based on AI-generated outputs.

    10. Indemnification

    You agree to indemnify and hold harmless InterviewCandy and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

    11. Termination

    We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the platform. Upon termination, your right to use the Service ceases immediately.

    12. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which InterviewCandy is incorporated, without regard to conflict of law provisions.

    13. Changes to Terms

    We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform. Continued use of the Service after changes constitutes acceptance.
